Welcome to KYMA Watches! The terms "we", "us" and "our" refer to KYMA Watches. KYMA Watches operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). KYMA Watches is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Note for EU/EEA consumers: Nothing in these Terms limits or excludes any statutory rights you have under applicable EU or Greek consumer protection law. Where any provision of these Terms conflicts with your statutory rights, your statutory rights prevail.
Section 1 — Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence.
To use the Services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
Section 2 — Our Products
We have made every effort to provide an accurate representation of our products in our online store. However, colors or product appearance may differ from how they appear on your screen due to your device type, settings, and configuration.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region or jurisdiction.
Section 3 — Orders
When you place an order, you are making an offer to purchase. KYMA Watches reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until KYMA Watches confirms acceptance and processes your payment.
Please review your order carefully before submitting, as KYMA Watches may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, change, or cancel an order, we will notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to our Refund Policy. EU consumers additionally have the right of withdrawal described in Section 5A below.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Pre-contractual information (EU Consumer Rights Directive): Before completing your purchase, we provide the following information: the total price including taxes and any additional charges; delivery arrangements and estimated delivery times; our identity and contact details; details of any right of withdrawal; and information about after-sales services and guarantees. This information forms part of your contract with us.
Section 4 — Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. All prices displayed include applicable VAT where required by law. Shipping, handling, customs, or import charges are shown separately at checkout before you complete your purchase.
You agree to provide current, complete and accurate purchase and payment information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are authorized to use the payment method provided, (iii) charges will be honored by your payment provider, and (iv) you will pay charges incurred including any applicable taxes and shipping costs.
Section 5 — Shipping and Delivery
We are not liable for shipping and delivery delays outside our control. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control (such as force majeure events).
Risk of loss: Risk of loss and damage to products passes to you upon physical delivery of the products to you, or to a person you have designated to receive them at the delivery address. This applies regardless of the shipping carrier used.
Section 5A — Right of Withdrawal (EU/EEA Consumers)
If you are a consumer located in the European Economic Area (EEA) or the United Kingdom, you have the right to withdraw from your purchase contract within 14 calendar days of the date on which you or a third party you designate (other than the carrier) receives the products, without giving any reason.

Return of products: You must send back or hand over the products without undue delay and no later than 14 days from the day on which you communicate your withdrawal to us. You bear the direct cost of returning the products unless we have agreed otherwise.
Refund: We will reimburse all payments received from you, including delivery costs (except for any supplementary costs arising from your choice of a delivery type other than the least expensive standard delivery we offer), without undue delay and no later than 14 days from the day we receive the returned products or proof you have sent them back, whichever is earlier. We will use the same payment method you used for the original transaction unless you have expressly agreed otherwise.
Exceptions to the right of withdrawal: The right of withdrawal does not apply to:
- Products that are made to your specifications or are clearly personalised.
- Products which are liable to deteriorate or expire rapidly.
- Sealed products that are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery.
Section 6 — Intellectual Property
Our Services, including all trademarks, brands, text, displays, images, graphics, video, audio, and the design, selection and arrangement thereof, are owned by KYMA Watches, its affiliates or licensors and are protected by Greek, European Union, and international intellectual property laws, including EU Directive 2019/790 on copyright and related rights.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. Unauthorized use may be a violation of applicable intellectual property laws.
KYMA Watches's names, logos, product and service names, designs, and slogans are trademarks of KYMA Watches or its affiliates or licensors. You must not use such trademarks without prior written permission. All rights not expressly granted herein are reserved.
Section 7 — Optional Tools
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have control or input over. We provide access to such tools "as is" and "as available" without any warranties or endorsement, and we shall have no liability arising from your use of optional third-party tools.
Section 8 — Third-Party Links
The Services may contain hyperlinks to websites operated by third parties. We are not responsible for the content, accuracy, or privacy practices of any third-party sites. If you access these sites, you do so at your own risk. Complaints regarding third-party products or services should be directed to the relevant third party.
Section 9 — Relationship with Shopify
KYMA Watches is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make are made directly with KYMA Watches. Shopify is not responsible for any aspect of any sales between you and KYMA Watches, including any injury, damage, or loss resulting from purchased products and services.
Section 10 — Privacy Policy
All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information about your use of the Services — see the Shopify Consumer Privacy Policy for details.
Section 11 — Feedback
If you submit any ideas, suggestions, feedback, reviews, or proposals (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose. You represent and warrant that you own or have all necessary rights to all Feedback you submit, and that it does not violate the rights of any third party.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine to be unlawful, offensive, or otherwise objectionable in our sole discretion.
Section 12 — Errors, Inaccuracies and Omissions
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.
Section 13 — Prohibited Uses
You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any applicable laws or regulations, including EU consumer protection and data protection law; (c) to infringe upon intellectual property rights; (d) to harass, abuse, defame, or harm any person; (e) to transmit false or misleading information; (f) to send unsolicited advertising or promotional material; (g) to impersonate any other person or entity; or (h) in any way that may harm KYMA Watches or users of the Services.
In addition, you agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, or exploit any portion of the Services; (c) collect the personal information of others without authorization; (d) use any automated means, robots, scrapers, or AI agents to access the Services; or (e) interfere with or circumvent the security features of the Services. We reserve the right to terminate your account at any time for violations of these Terms.
Section 14 — Agents
14.1 This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of any person or entity without direct supervision.
14.2 No Agent may access or interact with the Services unless it at all times identifies itself and operates in strict accordance with the requirements in section 14.4 below. No Agent may access the Services if we have requested it refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.
14.4 Agents must: (i) identify that the request is from an Agent and disclose the Agent name in the HTTP user agent string as "Agent/[agent name]"; (ii) not conceal or obfuscate that interactions are from an Agent, including by mimicking human behavior or circumventing CAPTCHAs; (iii) respond truthfully to any prompt seeking to determine if interactions are from a human or computer; (iv) not circumvent any measure intended to block or limit Agent access.
Section 15 — Termination
We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections will survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.
Section 16 — Disclaimer of Warranties
The information presented through the Services is made available for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information.
THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, OR NON-INFRINGEMENT.
EU/EEA consumers: Nothing in this section excludes or limits the statutory legal guarantee of conformity for goods provided under EU Directive 2019/771 on contracts for the sale of goods, or any other mandatory consumer rights under applicable Greek or EU law. If products are defective or do not conform to the contract, you are entitled to remedies under applicable law regardless of this disclaimer.
Section 17 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL KYMA WATCHES, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES.
EU/EEA consumers: This limitation of liability does not apply to: (i) liability for death or personal injury caused by our negligence; (ii) liability for fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded or limited under applicable Greek or EU consumer protection law; or (iv) your statutory rights under the EU legal guarantee of conformity for goods.
Section 18 — Indemnification
You agree to indemnify, defend and hold harmless KYMA Watches, Shopify, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any applicable law or the rights of a third party, or (3) your use of the Services.
We will notify you of any indemnifiable claim. We may control the defense and settlement of such claim at your expense but will not settle any claim requiring non-monetary obligations from you without your consent.
Section 19 — Online Dispute Resolution (EU)
If you are an EU consumer and have a complaint about a product or service you purchased from us, you may use the European Commission's Online Dispute Resolution (ODR) platform to seek resolution:

Section 20 — Severability
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity of any other remaining provisions.
Section 21 — Waiver; Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements, communications and proposals between you and us.
Section 22 — Assignment
You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent; any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
Section 23 — Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Greece and applicable European Union regulations.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Athens, Greece, except where mandatory applicable EU consumer protection law provides otherwise. If you are a consumer habitually resident in another EU member state, you may also bring proceedings in the courts of your country of habitual residence, and we may bring proceedings against you only in the courts of your country of habitual residence.
Section 24 — Headings
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Section 25 — Changes to Terms of Service
We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates on our website. We will notify you of any material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of the Services following posting of any changes constitutes acceptance of those changes.
